Administrative transparency ensures the greatest possible circulation of information between the administrative system and the outside world, promoting the relationship between public administrations and citizens' rights. Article 1 of Law 241/90 (amended and integrated by Law 15/2005) establishes that "administrative activity pursues the purposes determined by law and is governed by criteria of economy, effectiveness, publicity and transparency, according to the methods established by law as well as by the principles of community law". Therefore, not only is the right to view the documents of a procedure provided for, but also that administrative activity must be inspired by the principle of transparency, understood as accessibility to information and documentation of the administration or to the references used by the latter in assuming a certain position.
The principle of transparency understood as total accessibility to information concerning the organization and activity of public administrations was affirmed by Legislative Decree 14 March 2013, n.33. The aim of the law is to promote widespread forms of control over the pursuit of institutional functions and the use of public resources by citizens.
