The documents kept in the State Archives are freely available for consultation - art. 122, Title II - Chapter III of the Code of Cultural Heritage and Landscape (Legislative Decree 22 January 2004, no. 42 and subsequent amendments).
Exceptions are:
- those of a confidential nature relating to the foreign and internal policy of the State, which become freely available for consultation 50 years after their date
- those containing the "sensitive" data of private individuals (suitable for revealing racial and ethnic origin, religious, philosophical, political beliefs as well as membership of associations and parties and trade unions) limited to the last 40 years and unless the person has made a declared or implicit admission
- documents regarding the state of health, sexual habits and confidential family relationships, within the limits of 70 years
- criminal sentences that have become final and are recorded in the Criminal Record Office, which can be consulted after 40 years
However, art. 123, paragraph 1 - Title II - Chapter III, of the Code the possibility of authorising, with particular procedures and precautions, the consultation of confidential documents before the deadlines expire.
How to submit a request
The scholar for study reasons may request the consultation of confidential documents for historical purposes before the deadline.
To obtain the necessary authorization, the user must submit, to the State Archives of Pesaro-Urbino, a request for consultation of confidential documents, pursuant to art. 123 Legislative Decree 22 January 2004 n. 42 and subsequent amendments.
The request must indicate, in addition to the applicant's personal details, the specific reasons for study and the archive fund or funds (specifically pertaining to the purposes of the research) for which consultation is requested. The indications concerning personal identification data must be proven by showing an identification document whose details must be noted.
Once the favorable opinion of the Director of the State Archives of Pesaro-Urbino has been obtained, the request will be forwarded to the Prefecture of Pesaro directly by the State Archives.
Upon receipt of the decree authorizing consultation issued by the Ministry of the Interior, the State Archives of Pesaro-Urbino will forward it to the user, inviting them to come to the Study Room where, after completing the appropriate form, they will be able to access the consultation of the documents.
