Archives are cultural institutions that collect, inventory and conserve original documents of historical interest and ensure their consultation for study and research purposes (Cultural Heritage Code Legislative Decree 42/2004, art. 101, paragraph 2, letter c).

The State Archives of Pesaro are one of the one hundred State Archives that operate throughout the country, one for each provincial capital, and which depend on the  Ministry of Culture .

These institutions preserve the archives of the pre-unification Italian states and the documents of the judicial and administrative bodies of the unitary state present in the territory of competence and relating to the affairs concluded for over 30 years. The lists of conscription and extraction are instead paid seventy years after the year of birth of the class to which they refer, while the notarial archives deposit the notarial deeds received by notaries who ceased their professional practice before the last hundred years (Cultural Heritage Code Legislative Decree 42/2004, art. 41, paragraph 1).

The State Archives also preserve all other archives and individual documents that the State has received for use, on deposit or as a gift, for example private archives of significant historical interest.

They perform functions of protection and enhancement of the documentation that they conserve and ensure its public fruition, taking care of its organization, inventory and study. Finally, they protect the current and deposit archives of the State through special Surveillance Commissions (Cultural Heritage Code Legislative Decree 42/2004, art. 41, paragraph 5).
